LFCU Car Giveaway and Cash Prize SWEEPSTAKES RULES
3. Lockheed Federal Credit Union is the sponsor of the Sweepstakes. The Credit Union’s business address is 2340 Hollywood Way, Burbank, CA 91510. 4. Sweepstakes Period: Sweepstakes starts at 9:00 AM PDT. August 3, 2009 and ends at close of business August 8, 2009, 1:00 PM PDT. 5. Eligibility: To qualify for the Sweepstakes, all entrants must be at least 18 years of age, go to the sweepstakes location (LFCU’s branch locations) during the specified time period of the promotion (August 3, 2009, 9:00 AM PDT through August 8, 2009, 1:00 PM PDT) and complete one (1) entry form, guessing the pre-selected winning number Exactly in Sequence. Credit Union employees, officials, and members of their immediate families are not eligible to participate in the Sweepstakes. By entering this Sweepstakes, entrants accept and agree to be bound by these Official Rules and the decisions of the Credit Union. Sweepstakes void where prohibited by law. No mailed entry forms will be accepted. 6. Sweepstakes Entries: All individuals may submit only one (1) sweepstakes entry (guess) during the specified time period of the promotion. Entrants, who guess the pre-selected winning number Exactly in Sequence, will have a chance to win the Grand Prize, a 2009 Lexus IS 250. All entrants will be entered into a Second Chance Cash Drawing for a cash prize of $1,000. The winner will be randomly selected. Each individual can submit one (1) entry form. No one individual may be selected to participate on more than one occasion. If multiple entries are submitted by the same individual, only the first recorded entry will be eligible for the sweepstakes. Entries submitted after the specified time period of the promotion will be invalid and any claim made as a result of such entry will be denied. 7. Grand Prize Drawing: The individual who guesses the exact number in the “Lucky 6 Range,” 000,000 to 999,999, as determined by a non-affiliated third party company, Surebet Prize Indemnity Corporation, prior to this event may win a 2009 Lexus IS 250. Only an individual who guesses the pre-selected 6-digit winning number Exactly in Sequence will have a chance to win the 2009 Lexus IS 250. Special circumstance: Should two individuals correctly guess the pre-selected winning number Exactly in Sequence for the Grand Prize, a 2009 Lexus IS 250, the finalists will choose a number between 1 and 100. The finalist, who guesses the number, or closest to the number without going over, wins the vehicle. Grand Prize is a Lexus IS 250; year – 2009, four-door sedan, six (6) speed, automatic transmission, power tilt/slide moonroof with one-touch open/close, air conditioning and leather seats. Estimated valued, $40,000. Winner need not be present and will be notified by phone and/or mail on or after October 31, 2009. 8. Liability/General Rules: The Credit Union is not responsible for any loss, which may occur in connection with the Sweepstakes Entrant agrees to hold the Credit Union harmless from any liability arising from participation in the Sweepstakes or the acceptance, receipt, possession, or misuse of the prize. The Credit Union and each of its officers, directors, employees, members, and representatives and agents are not responsible for any negligence, claims, liability, injury, property loss, or other damages of entrants and/or winners arising from, or in connection with, acceptance, receipt, possession, or use/misuse of prize awarded or participation in this Sweepstakes. The Credit Union is not responsible for any incorrect or inaccurate information, whether caused by tampering, hacking, or by any of the equipment or programming associated with the Sweepstakes. Prize cannot be substituted, converted to cash, assigned, or transferred by winner. The Credit Union reserves the right to disqualify entrants who fail to follow these Official Rules and regulations or who make any misrepresentations relative to the Sweepstakes and redemption of a prize. Sweepstakes Rules Required by Surebet, the Event Indemnification Company: 9. Tax Issues: The Credit Union will report all prize winnings to the appropriate state and federal agencies as required by applicable law. Winner is responsible for all tax consequences (2009 Lexus IS 250 estimated at $40,000; second chance drawing at $1,000) of the prize. 10. Publicity Authorization: The winner agrees to permit the Credit Union to utilize his/her name and likeness in promotional and other Credit Union materials, without additional compensation or permission, except where prohibited by law. 11. Arbitration: Except where prohibited by law, as a condition of participating in this Sweepstakes, entrant agrees that (1) any and all disputes and causes of action arising out of or connected with this Sweepstakes or any prizes awarded, shall be resolved individually, without resort to any form of class action, and exclusively, by final and binding arbitration under the rules of the American Arbitration Association (“AAA”) and shall be held at the AAA regional office nearest the participant; (2) the Federal Arbitration Act shall govern the interpretation, enforcement, and all proceedings at such arbitration; and (3) judgment upon such arbitration award may be entered in any court having jurisdiction. Under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental, or consequential damages, or any other damages, including attorney’s fees, other than entrant’s actual out-of-pocket expenses (i.e., costs associated with entering this Sweepstakes), and entrant further waives all rights to have damages multiplied or increased. 12. Choice of Law: All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of entrant and the Credit Union in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the substantive laws of the State of California, USA, without regard to choice of law rules. All issues and questions concerning the construction, validity, interpretation, and enforceability of the Sweepstakes Rules Required by Surebet, the Event Indemnification Company portion of the Official Rules, with regard to the third party non-affiliate or the rights and obligations of entrant and the Credit Union in connection with the pre-selected winning number Exactly in Sequence, shall be governed by, and construed in accordance with, the substantive laws of the State of Florida, USA, without regard to choice of law rules. 13.
