Promotion Period: Individuals may only attempt this contest during the contest during the dates as listed on their eligible mail piece. Valid redemption dates for this contest are 1/18/10 through 2/28/10 during normal business hours at participating sponsor locations. The contest is subject to all federal, state and local laws and regulations and is void where prohibited. Who May Enter: Promotion is open to legal U.S. residents, aged 18 or older as of 1/18/10, who have a valid driver’s license and Social Security number, and who have received an eligible mail piece for this Promotion from the Sponsor via the U.S. Postal service, that is printed with their own name and address except the following classes of persons who are not eligible to participate:
How to Play: A total of approximately 24,000 mail pieces will be distributed for this promotion via the U.S. Postal Service to a random database of persons who reside within a designated radius of all of the participating sponsor locations listed below. Each mail piece will be printed with a unique serial number. One winning serial number will be randomly selected from all serial numbers distributed for this promotion as the grand prize winning serial number (see prize descriptions below). The mail piece printed and distributed with this serial number will be the only mail piece eligible to be redeemed for the grand prize. Each participating sponsor location will have the winning serial number and its corresponding prize description available during their normal business hours throughout the Promotional Period. In order to claim the grand prize, the addressee on the mail piece printed with the winning serial number must redeem their mail piece in person at a participating sponsor location prior to the promotion end date (2/28/10). No one may participate in this Promotion on behalf of another individual, or using a mail piece addressed to another individual. To determine if you have the winning mail piece, compare the original serial number printed on your mail piece to the grand prize winning number available at participating sponsor locations. If the original serial number printed on your mail piece exactly matches in order with the grand prize winning number available at the sponsor location, you will be eligible to claim the corresponding prize, subject to verification and compliance with these official rules (see “Claiming a Prize”, below). The winning mail piece must be redeemed in person at a participating sponsor location prior to close of business on the promotion end date. In the event the eligible contestant redeems the winning mail piece, that contestant will be required to present and surrender the original mail piece to an authorized sponsor representative. Do not surrender your mail piece to any other individual. There is a maximum of one prize award available for this contest. All properly claimed prizes will be awarded. Any unclaimed prizes will not be awarded. Difficulties with getting to a participating sponsor location to participate or claim a prize are not the responsibility of Sponsor. Eligible Redemption Requirements: The winning serial number may not be revealed over the phone or promoted or released in any form of media, including but not limited to publication on the Internet. If the winning serial number is compromised or released in any manner not expressly allowed under these contest rules, then the contest is void and no prize will be available for award. Any mail piece that is damaged in any manner, manipulated, duplicated, fraudulent, forged, destroyed, altered, copied, hand printed, or tampered with in any way, or is obtained outside authorized, legitimate channels, or contains any printing, production, typographical, mechanical or other errors or mechanical defects of any kind, will be considered null and void and will not be eligible for prize redemption. Only the original mail pieces received via the U.S. Postal Service in accordance with these rules may be presented for prize claim. A maximum of one (1) winning mail piece will be distributed for this promotion. Any act, error or omission that changes the odds of winning or results in multiple winning mail pieces being distributed in error will render all such mail pieces void. If valid prize claims exceed the available number of prizes as stated in these rules, the corresponding prize will be awarded in a random drawing from among all such eligible prize claims received. No more than the stated number of prizes will be awarded. Claiming a Prize: In order to claim the grand prize, the claimant must be the original addressee printed on the mail piece with the winning serial number, who received the mail piece via the U.S. Postal Service and who was on file with Million Dollar Media, LLC. All qualifying mail pieces presented for prize claims are subject to verification and approval by Million Dollar Media, LLC. If the original serial number printed on a valid mail piece exactly matches the winning prize number displayed in participating sponsor locations, then the eligible contestant must complete the following in order to validly claim the corresponding prize:
The name and address on your valid driver’s license must exactly match the name and address printed on the original mail piece printed with the winning serial number. Any prize claim submitted in any manner that is not specifically allowed under these contest rules will be disqualified and will not be eligible for any prize. All mail pieces submitted for prize claim are subject to verification and compliance with the official rules. Claimants may be required to submit to a phone and/or personal interview to verify the eligibility requirements as set forth in these official rules, and will be required to execute documents attesting to their eligibility. Prize Awards & Delivery: In the event that an eligible contestant redeems and submits the mail piece printed with the winning serial number during prior to the promotion end date, that contestant will be awarded the grand prize, subject to verification and approval by Million Dollar Media, LLC. The grand prize is: $10,000 Cash. A maximum (1) grand prize will be awarded. Grand prize winner(s) must accept delivery of prize from sponsor, or as otherwise instructed by sponsor. Sponsor reserves the right to substitute a prize of equal or greater value if an advertised prize becomes unavailable. Other restrictions may apply. All properly claimed prizes will be awarded. Any unclaimed prizes will not be awarded. Prize winner, if any, will be required to complete and return a W-9 form (if prize value exceeds $600.00), affidavit of eligibility, and liability/publicity release (Tennessee residents need not sign publicity release), and present a valid driver’s license and social security card before prize will be awarded. Winners of prizes greater than $600.00 will be issued a 1099 form reflecting the value of the prize(s) and are responsible for paying all income taxes on prize(s). Failure to collect or properly claim any prize in accordance with these rules will result in forfeiture of the prize. If forfeited for any reason, contestant will not receive any other prize substitution or compensation. Total ARV of all prizes: $10,000. Additional Rules & Restrictions: By participating, entrants agree to abide by and be bound by the Official Rules and the decisions of the Administrator, which shall be final in all matters relating to this contest. Any person attempting to submit a fraudulent mail piece or attempts to defraud Sponsor in any manner in connection with this promotion, may be prosecuted to the fullest extent of the law. In the event an entrant wins a prize, and is later found to be in violation of these rules he/she will be required to forfeit the prize or to reimburse Sponsor for the stated value of the prize if such violation is discovered after winner has used the prize. Participation in contest constitutes permission for the Sponsor and its agencies to use winners’ names and/or likenesses for purposes of advertising and trade in any media worldwide without limitation or further compensation unless prohibited by law. False, fraudulent or deceptive entries or acts shall render entrants ineligible for any prize. Sponsor and Administrator are not responsible for any typographical or other error in the printing or advertising of the offer, administration or execution of the contest or in the announcement of the prizes/prize winners. By accepting prizes, winners agree to hold sponsor, and released parties (collectively “Releasees”), from any claims, losses, actions, or damages of any kind, whether actual, incidental or consequential, for injury (including but not limited to death), damages, losses or expenses arising out of or relating to entrant’s participation in this contest, or the acceptance, possession or use/misuse of any prize, or participation in prize-related activities (including but not limited to travel related thereto), and to assume all liability in connection therewith. Releasees shall not be liable to any winner, entrant or any other person for failure to supply the prize or any part thereof by reason of any acts of God, any actions, regulations, orders, or requests by any governmental entity, equipment failure, terrorist acts, war, fire, unusually severe weather, embargo, labor dispute or strike, labor or material shortage, transportation interruption of any kind, or any other cause beyond Releasees’ sole control. No more than the advertised maximum number of prizes will be awarded for any reason. IN CASE OF DISPUTES: By participating, each entrant agrees that (1) any and all disputes, claims, and causes of action arising out of or in connection with this Promotion, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and any judicial proceeding shall take place in a federal or state court within the State of New Jersey; (2) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion, but in no event attorneys' fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental, and consequential damages, and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and Sponsor in connection with this Promotion, shall be governed by, and construed in accordance with the laws of the State of New Jersey, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of New Jersey or any other jurisdiction), that would cause the application of the laws of any jurisdiction other than the State of New Jersey.
